1. Introduction

Welcome to KashWork Ecommerce Private Limited (“we”, “our”, “us”). By registering as a seller on https://seller.kashwork.com (“KashWork” or “Site”), you agree to comply with and be bound by the following Terms and Conditions (“Terms” or “Agreement”).
These Terms govern your access to and use of our platform, tools, and services.
By using KashWork, you confirm that you have read, understood, and accepted these Terms.

If you do not agree, please do not register or use our platform.

 

2. Seller Registration and Account

2.1 Registration Requirements

  • You must provide accurate, current, and complete information during registration.
     
  • By registering, you represent that you are at least 18 years old and legally capable of entering into binding contracts.
     
  • We reserve the right to verify your identity and reject or suspend your account if any information is found to be inaccurate or misleading.
     

2.2 Account Responsibility

  • You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
     
  • Immediately notify KashWork at [email protected] of any unauthorized use or security breach.
     
  • You are responsible for keeping your contact, payment, and tax details up to date.
     

 

3. Fees and Payments

3.1 Subscription Fee

  • Two plans are available:
     
    • Gold Membership – ₹999 per year
       
    • Exclusive Stores – ₹4,999 per year
       
  • The subscription fee is non-refundable and required to maintain an active seller account.
     

3.2 Listing Fee

  • Listing products on KashWork is free of cost.
     

3.3 Final Value Fee

  • A final value fee, as a percentage of the sale amount, will be deducted upon each successful sale.
     

3.4 Marketplace Fee

  • A marketplace fee, as a small percentage of the sale price, applies on all completed transactions.
     

3.5 Payment Schedule

  • Payments are released to your registered bank account within 29 days after successful delivery, after deducting applicable fees.
     
  • Payments may be delayed in case of disputes, chargebacks, or suspected fraudulent activity.
     

3.6 Taxes

  • You are responsible for paying all applicable taxes, including GST, VAT, or other international taxes based on your location and sales region.
     
  • KashWork may withhold or deduct taxes where legally required.
     

 

4. Listing and Selling

4.1 Product Listings

  • Sellers have full control over pricing.
     
  • Listings must be accurate, lawful, and not misleading.
     
  • Misrepresentation, copyright infringement, or false claims may result in suspension or termination.
     

4.2 Prohibited and Restricted Items

  • You must not list or sell:
     
    • Illegal, counterfeit, or stolen items
       
    • Products violating intellectual property or safety laws
       
    • Items restricted by KashWork’s Prohibited and Restricted Items Policy
       

 

5. Order Management and Fulfillment

5.1 Order Notifications

  • You’ll receive order notifications via email or mobile. Ensure your contact details are accurate.
     

5.2 Packing and Dispatch

  • You must pack products securely and mark them as “Ready to Dispatch” within the specified timeframe.
     
  • KashWork logistics partners handle the pickup and delivery. Sellers are not required to ship independently.
     

 

6. Cancellations, Returns, and Exchanges

6.1 Order Cancellations

  • By Buyer: Buyers may cancel orders before dispatch.
     
  • By Seller: You may cancel only for valid reasons such as unavailability or quality issues. Repeated cancellations may affect your account status.
     

6.2 Returns & Exchanges

  • No returns are permitted.
     
  • Exchanges are allowed only if:
     
    • The product is damaged, defective, or incorrect (e.g., wrong size, color, or model).
       
  • Buyers must request an exchange via their KashWork account. You must respond within 3 business days.
     
  • Our logistics partner will manage pickup and delivery of exchange items. Use KashWork-provided labels for shipments.
     
  • For Porter Pickup/Drop-off, buyers will receive a WhatsApp notification with seller address for drop-off.
     

 

7. Compliance and Legal Obligations

7.1 Seller Obligations

  • You agree to comply with all applicable laws, including:
     
    • Consumer protection laws
       
    • Data protection and privacy regulations (GDPR, CCPA, etc.)
       
    • Export/import controls and tax obligations
       
  • You are responsible for ensuring your products meet required quality, safety, and labeling standards.
     

7.2 Intellectual Property

  • You confirm that you own or have the necessary licenses for all product content you upload.
     
  • By listing on KashWork, you grant us a non-exclusive, worldwide, royalty-free license to use your content for marketing and promotional purposes.
     
  • If you believe your IP rights have been infringed, contact [email protected] with details and evidence.
     

 

8. Data Protection and Privacy

  • By using our platform, you consent to data collection, storage, and processing as described in our Privacy & Cookie Policy.
     
  • KashWork complies with international data protection laws (GDPR, CCPA, and India’s DPDP Act).
     
  • When you delete your account, we perform a soft delete—your phone number is anonymized to prevent re-login with the same number. To rejoin, you must register a new account.
     

 

9. Limitation of Liability

KashWork, its directors, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising from:

  • Your use or inability to use the platform
     
  • Unauthorized access or misuse of your data
     
  • Interruptions, technical failures, or security breaches
     
  • Third-party actions or negligence
     

Our total liability shall not exceed the total fees paid by you to KashWork in the 12 months preceding the claim.

 

10. Indemnification

You agree to indemnify and hold harmless KashWork, its affiliates, employees, and agents from all claims, damages, losses, and expenses (including attorney fees) resulting from:

  • Your use of the platform
     
  • Violation of these Terms
     
  • Infringement of any third-party rights
     

 

11. Termination and Account Deactivation

  • KashWork reserves the right to suspend or terminate your account for policy violations, fraudulent activities, or legal non-compliance.
     
  • Upon deletion, we soft delete your account, anonymize your phone number, and retain necessary records as required by law.
     
  • You can re-register with your number, but previous data will not be restored.
     

 

12. Changes to Terms

We may modify these Terms at any time. Updates will be posted on https://seller.kashwork.com with the “Last Updated” date revised accordingly.
Your continued use of the platform after any changes constitutes acceptance.

 

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with:

  • Indian Law for users operating in India; and
     
  • Applicable international trade and consumer protection laws for global sellers.
     

Any disputes shall be subject to the exclusive jurisdiction of the courts of Chandigarh, India, unless otherwise required by applicable international law.
