Welcome to KashWork Ecommerce Private Limited ("we", "our",
"us").
By registering as a seller on KashWork.com ("KashWork" or "Site"), you
agree to comply with and be
bound
by the following terms and conditions ("Terms & Conditions" or "Agreement"). These terms govern
your
use of the Site and services provided by KashWork. Please read them carefully before using our
platform.
1. Seller Registration and Account
- 1.1 Registration Requirements
- 1.1.1 To become a seller on KashWork, you must complete the registration process by
providing current, complete, and accurate information as required by the
registration
form.
- 1.1.2 By registering as a seller, you represent and warrant that you are at least 18
years
old and capable of forming legally binding contracts.
- 1.2 Account Responsibility

1.2.1 You are responsible for maintaining the confidentiality of your account
information, including your password and any activities that occur under your
account.
Notify us immediately of any unauthorized use of your account or any other security
breach.
2. Fees and Payments
- 2.1 Subscription Fee

2.1.1 The store subscription fee includes two plans: 'Small Business' for ₹99 per
year and 'Gold Membership' for ₹999 per year. This fee is non-refundable and
allows
you to maintain an active seller account on KashWork.
- 2.2 Listing Fee
- 2.2.1 Listing your products on KashWork is free of cost. There are no charges for
listing your products on the platform.
- 2.3 Final Value Fee
- 2.3.1 KashWork charges a final value fee based on the total amount of the sale once
an
item is sold. This fee is a percentage of the selling price and is deducted from
your
payment before it is transferred to your registered bank account.
- 2.4 Marketplace Fee
- 2.4.1 A small marketplace fee, which is a percentage of the selling price, is
applicable
upon a successful sale. This fee is deducted from the payment transferred to your
registered bank account.
- 2.5 Payment Schedule
- 2.5.1 Payments for your sales will be processed and transferred to your registered
bank
account within 29 days after the product is successfully delivered to the customer,
after deducting the relevant KashWork fees.
3. Listing and Selling
- 3.1 Product Listings
- 3.1.1 As a seller, you have full control over the pricing of your products. You can
set
the price based on your business strategy and market dynamics.
- 3.1.2 Ensure that your product listings are accurate, complete, and comply with all
applicable laws and regulations. Misrepresentation of products may result in
penalties
or account suspension.
- 3.2 Prohibited Items
- 3.2.1 You may not list or sell any item that is illegal, counterfeit, stolen, or
otherwise prohibited by KashWork's policies or applicable laws.
- 3.2.2 Refer to the KashWork Prohibited and Restricted Items Policy for a detailed
list
of items that cannot be listed or sold on the platform.
4. Order Management and Fulfillment
- 4.1 Order Notifications
- 4.1.1 You will receive a mobile or email notification every time you receive an
order,
depending on your preferences. Ensure your contact information is up to date to
receive
timely notifications.
- 4.2 Packing and Dispatch
- 4.2.1 You are responsible for packing the sold items and marking them as 'ready to
dispatch' within the given timeline. Use appropriate packaging materials to ensure
the
product reaches the buyer in good condition.
- 4.2.2 Our logistics partner will pick up the orders from your location and deliver
them
to the customers. You do not need to ship items yourself.
5. Cancellations and Returns
- 5.1 Order Cancellations
- 5.1.1 By Buyers: Buyers can cancel their orders before the order is
dispatched.
If a
buyer cancels an order, you will be notified, and the item will be marked as
available
for sale again
- 5.1.2 By Sellers: As a seller, you can cancel orders due to product
unavailability or
other unforeseen circumstances. If you need to cancel an order, inform the buyer and
update the order status promptly. Repeated cancellations may affect your seller
rating
and account status.
- 5.2 Returns and Exchanges
- 5.2.1 KashWork does not allow returns on its platform. However, we do allow
exchanges
under specific conditions:

The product received by the buyer is damaged or defective.
- The product received by the buyer is incorrect (e.g., wrong size, color, or
model).
- 5.2.2 To facilitate an exchange, the buyer must initiate the request through their
KashWork account. You will receive a notification of the exchange request and must
respond within 3 business days.
- 5.2.3 If the exchange request is approved
For standard pickup:
- Our logistics partner will handle the pickup and delivery of the exchanged
item.
Ensure the replacement product meets the buyer's requirements and is
dispatched
promptly.
Shipping for Exchanges
- Ensure you use the exchange label
provided by KashWork.
For Porter Pickup/Drop-off: Once the seller approves, you will receive a WhatsApp notification with the
seller's pickup/drop-off address.
Buyers must:
- Drop off the product at the seller's location (for ultra-fast exchanges)
6. Compliance and Legal
- 6.1 Seller Obligations

6.1.1 You must comply with all applicable laws, regulations, and KashWork policies
while
listing and selling products on the platform. This includes, but is not limited to,
consumer protection laws, intellectual property laws, and tax laws.
- 6.1.2 You are responsible for the quality, safety, and legality of the products you
list
for sale. Ensure that your products meet all relevant standards and regulations.
- 6.2 Intellectual Property
- 6.2.1 You represent and warrant that you own or have the necessary licenses, rights,
consents, and permissions to use and authorize KashWork to use any intellectual
property
contained in your product listings.
- 6.2.2 If you believe that your intellectual property rights are being infringed,
please

necessary information to
address the
issue.
7. Data Protection
- 7.1 Personal Information
- 7.1.1 By using KashWork, you consent to the collection, transfer, storage, and use
of
your personal information as described in our Privacy & Cookie Policy. We take the
privacy and security of your information seriously and implement appropriate
measures to
protect it.
- 7.2 Data Security
- 7.2.1 We implement a variety of security measures to protect your personal
information,
including SSL encryption, access controls, and secure server environments.
8. Limitation of Liability
- 8.1 KashWork and its affiliates, officers, employees, and agents are not liable for any
indirect, incidental, special, consequential, or punitive damages, or any loss of profits or
revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or
other
intangible losses resulting from:
- Your use or inability to use the platform.
- Any unauthorized access to or use of our servers and/or any personal information
stored
therein.
- Any interruption or cessation of transmission to or from the platform.
Any bugs, viruses, trojan horses, or the like that may be transmitted to or through
our
platform by any third party.
- Any errors or omissions in any content or for any loss or damage incurred as a
result of
your use of any content posted, emailed, transmitted, or otherwise made available
through
the platform.
9. Indemnity

9.1 You agree to indemnify and hold KashWork, its affiliates, officers, employees, agents,
and
representatives harmless from any claims, demands, losses, liabilities, and expenses
(including
attorneys' fees) arising out of or related to:
- Your use of the platform.
- Your breach or violation of any of these Terms & Conditions.
- Your violation of the rights of any third party, including other users of the
platform.
10. Changes to Terms & Conditions
- 10.1 KashWork reserves the right to update or modify these Terms & Conditions at any time
without prior notice. Any changes will be effective immediately upon posting on the website.
We
encourage you to review these terms periodically for any updates.
11. Governing Law and Jurisdiction
- 11.1 These Terms & Conditions shall be governed and construed in accordance with the laws of
the
Republic of India. The courts at Chandigarh, India, shall have exclusive jurisdiction on all
matters and disputes arising out of and relating to the platform.
